Terms of Service

01Who we are

These terms are an agreement between you and VPSRely, which runs VPSRely at vpsrely.com. We call ourselves "we" and "us".

By ordering or using a server you accept these terms. If you do not accept them, do not place an order.

02Your account

You must be at least 18 and able to enter a contract. Give us accurate details and keep them current.

You are responsible for everything done through your account and your servers. Keep your logins private and tell us at once if you think someone else has access.

03What we provide

We provide virtual servers with the vCPU, RAM and storage listed on the plan you order, plus a control panel to reboot, reinstall and monitor them.

Servers are unmanaged. You run the operating system, the software on it, security updates and backups. Support can help with the platform and the control panel, and we may help with your own software when we have time, but we are not obliged to.

04Orders, payment and renewal

You pay monthly in advance. Each server renews automatically every month until you cancel. Prices are in US dollars and exclude any tax we must charge.

If a payment fails we may suspend the server after 3 days and delete it after 7 more days. We will email you before either step.

If we change a price, we will tell you by email before it applies to your next renewal.

05Cancellation and refunds

You can cancel at any time from your account. The server keeps running until the end of the month you have paid for.

Refunds are covered by the refund policy.

06Acceptable use

You must follow the acceptable use policy. Breaking it can lead to suspension or termination.

07Your data and backups

You own the data on your server. We do not look at it except where you ask us to for support, where it is needed to keep the platform secure, or where the law requires it.

Back up anything you cannot afford to lose. After a server is cancelled or terminated we delete its data within 30 days and cannot recover it.

How we handle personal data is explained in the privacy policy.

08Service levels

Our uptime commitment and the credits that apply if we miss it are in the service level agreement. Credits are the only remedy for downtime.

09Suspension and termination

We may suspend or end your service when:

• you break the acceptable use policy or these terms
• a payment is overdue
• a court, regulator or law enforcement body requires it
• your server is a security risk to other customers or to the network

10Liability

Nothing in these terms limits liability that the law does not allow us to limit, including liability for death or personal injury caused by negligence and for fraud.

Otherwise, our total liability to you for any claim is limited to the fees you paid us in the 12 months before the claim. We are not liable for lost profit, lost data or indirect loss.

Except where these terms say otherwise, the service is provided as it is.

11Changes to these terms

We may update these terms. For changes that matter, we will email you at least 14 days before they apply. If you keep using the service after that date, you accept the new terms.

12Governing law

These terms are governed by the laws of the country where VPSRely is registered, and the courts of that country can hear disputes.
